The 5,000-visitor threshold is a legal reference figure, not a general limit

The 5,000 threshold has a specific legal scope, but it is not a general limit for event safety.

Updated: · MOVETOS

In Germany, the figure of 5,000 visitors is an important legal reference for certain assembly venues. It is not, however, a general limit above which event safety planning or a safety concept first becomes necessary.

Where the figure comes from

One main origin of this figure lies in assembly venue law. Under section 43(2) of the Model Assembly Venues Ordinance, a safety concept agreed with the competent safety authorities must be drawn up for assembly venues with more than 5,000 visitor places. The respective state regulations are legally decisive.

Three reference figures

The distinction between the reference figures is crucial:

  • 5,000 visitor places: describes the visitor capacity provided for an assembly venue.
  • 5,000 visitors present at the same time: describes the actual occupancy at a given moment.
  • 5,000 visitors per event day: describes the number of visitors over a period, including possible turnover.

These figures are not equivalent, either legally or in terms of safety.

No general limit

At town festivals, fairs and other events in public space in particular, the safety scope required depends on further factors: terrain and accessibility, visitor movements, event programme, traffic conditions, hazard potential, and the options for warning and evacuation.

An event with well under 5,000 visitors can therefore also require extensive safety measures. Conversely, a higher visitor number alone does not show which specific measures are appropriate.

Threshold, requirement, trigger

For planning, a distinction must also be made between statutory thresholds, official requirements and operational trigger criteria. A legal limit for drawing up a safety concept, for example, is not an automatic trigger for evacuating an event.

Conclusion

The 5,000 threshold has a specific legal scope. For the actual safety of an event, however, what matters is which hazards exist, which requirements apply, and how the planned measures work under the given conditions.
